I am H1B status holder, but I didn't get stamped in my passport. I knew that I can use Automatic Visa Re-validation to go to Canada for less than 30 days. I need to attend a conference there for only a week. I also applied for EB2 green card, I-140 is sent a month ago. Will I have a problem to re-enter USA again?|||You can travel to Canada or Mexico for up to 30 days provided that:
- you keep your I-94 form when your enter Canada
- your I-94 remains valid at the time you attempt to re-enter the US
- you are in possession of your H1B approval notice when you re-enter the US
If you applied for H1B status after your last arrival into the US and received an approval, USCIS should have issued a new I-94 for you.
%26gt; Check your H1B approval notice - the new I-94 is the lower right corner of the approval notice. Tear it off and attach it to your original I-94 you received when you entered the country (as per instructions on the approval notice) %26lt;
You will be able to re-enter the US with the approval notice and that I-94 after a brief visit to Canada.
Please note that you will not be able to return back to US using automatic visa revalidation if you stay in Canada for more than 30 days or if you apply for a new US visa while you are in Canada.
See the link below for more info on Automatic Revalidation|||I have never heard of Automatic Visa Revalidation. Perhaps it is something new but there is no information on it that I have found. According to official information you will need a visa and valid passport to return from Canada. Official site here: https://help.cbp.gov/app/answers/detail/鈥?/a>
