How does this work with changing status of holding a social security card?

If a person have a social security card and the persons credit is messed up will it still affect that person after that person becomes a citizen?|||Creditors and the credit bureaus use social security numbers as identifiers, but bad credit really has nothing to do with the social security administration or your citizenship status. Negative items on your credit report will still be there after you become a citizen.

How many days max a US grenn Card holder stay ouside US without affecting application of citizenship status?

Basically i m a greencard holder and i have also applied for US Citizenship. There is requirement that a green card holder must reside in US for 60 months to get the US passport. but a person can travel outside US for a certain time period without affecting the citizenship requirement status. i just need to clairfy that what is the maimum number of days i could stay outsude US without affecting the limit of 60 Months stay at US.|||In terms of Continuous Residence for US citizenship purposes, If you leave the United States for more than 6 months, you are no longer eligible.

http://www.uscis.gov/files/article/M-476鈥?/a>|||If you're gone more than 6 months you must start your 60 months over from the beginning.|||hi, it is 180 days within 5 yrs.

Help to get someone legal status (green card) for the United States.?

Someone i know is using a lawyer's office to help with the paperwork and her petition to get legal status...green card. It seems legit but seems to me the lawyer is charging a high price for this service. What benefit is there using a lawyer. Is it just the paper work they perform, to make it easier for you. They cannot put your paper work on top of the pile at the immigration office anyway. Is there any free immigration services in New York City that one can recommend. Thanks to all.|||It's not possible to become legal if your illegal.|||What is the person's current legal status in the US, and on what grounds are they trying to obtain a green card? This is crucial info! If the person is not legally present in the US, it is highly unlikely that any immigration attorney can ever obtain legal status and GC for that person. They will charge very high fees (fees can run $25,000), and they will try this-that-%26amp;-t'other, but there is almost no chance whatsoever that the person can ever be "legalized' no matter what they do. There is no way to legalize an illegal alien, not even marriage or procreation.

If the person is legally present in the US, fees will depend on their current status and grounds for applying for legal permanent residence. E.g. for marriage, legal fees, including all filing fees, typically run about $3000, could run up to about $5000. Remember filing fees alone run well over $1000 if the person entered on fiance visa and is filing to change status from fiance visa to legal permanent resident.

Free immigration services? An immigrant is expected to be able to support themselves and pay their own way. If they want an attorney, they need to pay for the service. But if fees are high, it is probably because their situation is complicated, or else they are illegal and they are going to end up going home.

If this person is not legally present, be sure you do absolutely nothing whatsoever to "help" them as you could be violating various laws prohibiting aiding %26amp; abetting illegal aliens. Do not allow an illegal alien to stay in your home, ride in your car, etc.|||If the person is already here illegally then there isn't anything anyone can do..with a lawyer ot without. If the person is here legally then you are going to need a lawyer. Yes, they are expensive, but that's because you need them.|||You dont say the method of getting the green card ..if its marriage the legal fees will be around $2-3k from the lawyer other method could be a lot more

The benefit is knowing what and when to file|||You tell us noting about the case, only how much the lawyer charges.

Go to http://www.visajourney.com and read the Guides.

My father inlaw is permanent resident of US. And her daughter losted her green card status.?

My father inlaw is permanent resident of US. And her daughter losted her green card status. Her father again sponsors her daughter and recently got approval. Tell me please how i can get visa. As we get marriad recently 3-months ago and her case was submitted by her father about two and half year before. And how much time embassy or consulate will take to give approval to go US with her?

Please reply me soon for us visa|||well, legal permanent residents can't sponsor married children. only US citizens can do that. so, when she married you, that made her petition null and void. he can file a new petition after he becomes a citizen, but for now, she's no longer eligible for a visa.|||Dear George

Thanks for your attention on my question. Her father has US citizenship. Sorry. Now let me know whats the probability for petition and how i can apply and how much time embassy will take?

Thanks George

|||They should have notified USCIS that she was married. It would have meant you would have also derived a visa/green card at the same time.

Now you will have to wait until she becomes a US citizen in 5 years time before she can petition you. Then it will take roughly another year for the petition to be processed.|||Both answers are good.

Make sure no one lies about it. If you try to lie about your daughter's marital status, and Immigration and Consulate finds out, it will be a lifetime bar to get visa in the future.

If someone has aslylum status and has not applied for green card after one year?

Hello , i just want to ask if someone has asylum status and has not applied for a green card after the one year waitng period, and his EAD expired a couple months ago, does he neeeds to apllied for a new EAD when he sent the paper for a green card I-485? or just file the I 485?|||Your asylum or refugee status is indefinite. But after one year with either status, you should apply for perm status. Technically, by law you have to apply at one year refugee status. But they won't deport you if you don't.

But if you don't, you stand the chance of losing your AS/RE status. Because after one year, DHS can re-evaluate the conditions that led to your status and potentially find that they no longer exist.

Which means, your status could be revoked.

And while that almost never happens, why take that chance? As either an asylee or a refugee, USCIS more often than not waives the application fees when you timely apply. Which means in about year. The longer you're in the States, the more time you have to accumulate wealth, so the less likely they'll waive the fees.

Just do it.|||As a refugee, you are required by law to apply for permanent resident status 1 year after being admitted to the United States. As an asylee, you are not required to apply for permanent resident status after being granted asylum for 1 year, although it may be in your best interest to do so.

If you have the parents enrollment numbers then you use them to enroll. The tribe can usually search their database at a cost if you only have the vital statistics.

If he is one of the "Civilized Tribes" (Creek, Choctaw, Chippewa, Seminole, and Cherokee), then an ancestor must appear on the Dawes Rolls (usually a grandparent or great grandparent). The Rolls have what degree of blood some of the people had.

I highly doubt you can adjuct status to anything at all with that visa, especially in removal procedings.

EDIT: I just checked and you have to have a compelling reason you can't return to your country, and you are a person of good moral character, and granting a green card would be in the national interests of the US

I was born in Ontario, and I have a North American Indian Status card?

Am I a dual citizen according to the U.S. Can I legally work there?|||First Nations and Native Americans Born in Canada are entitled to enter the United States for the purpose of employment, study, retirement, investing, and/or immigration.

The "Jay Treaty", provides that American Indians can travel freely across the international boundary. The United States has codified this obligation in the provisions of Section 289 of the Immigration and Nationality Act (INA) .

The INA does not distinguish between "treaty" and "non-treaty" or "status" and "non-status" Indians as determined by Canadian law. The only relevant factor is whether the individual has at least 50% American Indian blood.

A Canadian-born American Indian cannot be denied "entry" to or "Permanent Resident Status" in the United States

This is a “Treaty Right” not Citizenship in the United States.

First Nations and Native Americans Born in Canada

A dual citizen? No, you are a citizen of the country where you were born, but that does not mean you cannot easily cross the border. The only relevant factor is whether the individual has at least 50% American Indian blood.

In order to qualify under Section 289 of the INA, eligible persons must provide evidence of their American Indian background to the U.S. Department of Homeland Security Customs and Border Protection (DHS/CBP) officer at the intended Port of Entry.

The documentation must be sufficient to show the bearer has at least fifty percent of American Indian race. Such a person may then be admitted without a visa. You are going to need identification that helps to establish that you have at least 50% American Indian blood.

North American Indians born in Canada granted permanent resident alien status will be issued a resident I-551 (green card) by DHS. Recipients are entitled to all rights and privileges accorded legal immigrants to the United States, including if they desire, eventual naturalization as American citizens and the right to sponsor immediate family members into the United States. Resident aliens are entitled to file on behalf of a spouse and unmarried children if they are not also eligible to be admitted under Section 289 of the INA.

Maintaining green card status?

I got my green card in january 2007 , i stayed here for two months and went back to my home country and i came back in august 2007 after five months,

But the problem is that i again have to go back in october for a little longer time. so now i am in trouble how to maintain my green card status and not going into any trouble when i will come back. till now i have not filled any tax returns.

please suggest me what should i do and how to proceed as i want to stay here permanently and don't want to abadon my green card status.

secondly i also don't want to be in trouble when i will come back, how can i convince the immigration officer about it.

Thanks|||Go to Citizenship and Immigration Services, ask for a re-entry permit. This will allow you to stay outside the US longer, as long as you plan to keep your residency in the future.

And you are right, it is the CBP Officer that you have to convince. If you have re-entry permit then we won't send you to secondary. If you do not have the permit you are going to have a nice long chat with us as to why you are not living up to your residency requirements.

However, unlike a previous poster said there is not a magical one day over rule. Unfortunately the courts recognizes whole shades of grey on the matter.|||You can leave for up to six months and then request an extension on top of that.|||It has nothing to do with convincing the INS officer. The law is very strict, one day over your maximum time outside the US and your green card evaporates, just like on Mission Impossible.

Work permit, adjustment of status, green card, unemployment benefits?

I had a work permit for a couple of years before become a permanent resident through marriage, I lost my job because of the economy and I'm waiting for my green card to show up in the mail. Am i eligible to apply for unemployment benefits? I have been paying taxes for years.|||Unemployment benefits are provided by state unemployment insurance programs within guidelines established by Federal law.

Eligibility for unemployment insurance, benefit amounts and the length of time benefits are available are determined by state law.

You need to search for your answer in the website for your state. Where I live, permanent residents are eligible for unemployment checks, and I imagine that's true for the other 49 states.

Most states do not pass laws that are harmful to lawful permanent residents.|||yes, you are.

Do native american with indian status card pay taxes in stores?

In the US ALL people pay taxes in stores, even American Indians. The only exception is on reservations where there are no taxes and then nobody pays taxes. The exception to this would be cigarettes and gas. Sometimes states make tribes collect taxes equal to state tax so that the tribes do not undercut the state competition. This tax is usually only applied to non-AI people.

Canada may be different and exempt First Nations people with status cards from paying taxes in stores.|||I have used my indian status card in New York, Florida, Utah and Nebraska and was exempt from hotel and retail sales taxes where applicable. Can a person out of status on a visitors or a students visa marry a U.S citizen and obtain a green card? If she has been here without a current visa she will need to fill out the I-601c form which is a $545 dollar form asking for forgiveness (waiver) to overcome the 10 year bar that will be put in place as soon as she leaves the country. I suggest you talk to a lawyer (immigration) because the forms need to be done properly, there are certain things that USCIS looks for. You will also have to have a marriage interview, she does not have to be present but hopefully you can get your I-130 processed before she leaves. THey will fingerprint her at an ICE office and then send the paperwork to the NVC National Visa Center and then she needs to leave to have her interview at the consulate in her country. A green card wait in Mexico for example is 8 years but as your wife she will be moved to the front of the line but it still can be a long wait. It is legal to marry an undocumented person but it brings with it allot of issues so make sure your up for it. Copy all her paperwork so you have all the information here in the US. Get reference letters from US Citizens telling what type of person she is to show she is has been productive while here.|||Any student here with an F-1 visa knows that their stay in the US is contingent on them going back to their home country upon completion of their studies.

Your girlfriend is not only out of status she is now an illegal alien. There is nothing to keep her from marrying you as long as you are aware of that fact.

Even if you were to marry her tomorrow that marriage certificate does little to change her legal status in the US. Go to the ICE website to get informed on what options are available to your wife if and when she marries you.|||No. She must return to her country and reapply from there. That is providing she does not end up with a ban from the U.S. on top of everything.

1. For dropping out of school on her student visa. A violation of the condition for her getting the student visa in the first place.

2. For overstaying.

As long as your spouse is not a US citizen, you'll have to wait until a ticket becomes available for you. Depending on your country, that can take months or years. Another problem is that your F1 is probably linked to a 2-year home residency requirement. Thus, after you finished studying, you have to go to your home country for 2 years.

Therefore, I suggest that your spouse only files for the I-130 (petition for an alien spouse) and waits with the AOS until he or she becomes a US citizen. At that point there's no waiting time anymore, and you can try to apply for a waiver.

I ran up a 20,000 credit card debt am capable to pay off entire debt, after payoff can I redeem former status?

Since I am paying entire credit card balance is there a chance to get my credit status returned?|||If you pay it off in full it will return to R1 Status within two years.|||If you are not in default (current) on your cards....sure you can get your former status back. If your cards are defaulted/charged-off, it becomes more complicated. Simply cutting checks to your creditors after a charge-off will not magically redeem your credit....The charge-off notation will remain...it will be updated to "paid" but the damaging charge-off notation will remain just as if you have never paid.

If you are in a position to pay off all defaulted debt at the original amount....You need to do what is a called a "Pay for Delete," where your creditors remove the negative notations when they are paid....Get the terms IN WRITING FIRST with each creditor that they'll delete the negative notation upon payment. DO NOT wait till after you pay them as they have no incentive to do anything for you. If you're dealing with collection agencies, this can be tricky...so be careful...Insist on getting agreements with supervisors with confirmed real names for any agreements with collection agencies.

I am an f1 student and and I will finish studying very soon(few months),Will I be able to stay legal in the country in case I loose my status when I already applied for a green card through my sister?

I know it takes about 10 years to get the green card through a sibling, Will I remain legal until then?|||No, you cannot remain in the US while your sister's petition is pending. You must wait in your own country until a visa becomes available. Do not overstay your student visa! Do not do anything whatsoever which violates your visa regulations. If you do, you jeopardize your chance at future immigration.

BTW, a condition of issuing a student visa is that the student intends to return to their country of citizenship immediately upon completion or termination of studies. Be sure you return to your country immediately upon completion or termination of your classes.|||Definitely not. The petition gives you no authority to remain in the US. Do not overstay. Could I still get an Indian status card if I'm only half Native?

My father, grandmother and great grandmother are all full blooded Native that are all Ojibwe (as well as Cree, I think) so I think I am half Native because my mother is Portuguese that gives me Portuguese descent as well. Am I able to get Indian staus with these conditions?|||It depends.

The members of your family who are Native must be from a Nation that signed a treaty with Canada. They would have been "Status Indians". Then you would qualify for a "Status Card" if you are 1/4 or more Native.

But if your Nation did not sign a treaty with Canada then you don't qualify for a "Status Card" even if you are a full-blood Native.

ETA

If your family are from an Ojibwe Nation they would have signed a treaty with Canada. That may also be true for the Cree. Most if not all Cree Nations signed a treaty with Canada.

.|||Yes you can still get one.

I work with H1B status. My boyfriend is a green card holder. My work position seems to be in danger now. If I get laid off, I will lose my H1B status immediately. Can I keep legal status and stay in US by marrying my boyfriend?|||If you marry your boyfriend, technically you can apply for the partner to the green card. However it is a grey area whereby you are marrying after they have been given a green card.

You should be fine if you can prove the relationship. Hopefully you wont have to make this choice.

Im wanting to apply for a green card, im currently here under the Temporary Protected Status for Honduras. Believe it or not, under TPS you are expected to return home at some point in the future. That's what the "T" means.... Temporary.|||There is no way you can apply for asylum or obtain any green card. TPS is Temporary! You are required to return to your own country, and cannot remain in the US. You have no choice but to return to Honduras, then if you ever qualified, apply for legal entry, visa, immigration, whatever you qualify for at that time.|||You cannot file for a green card while you are on TPS. When the TPS for your country is no longer extended, you are going to have to return home. You have only been given permission to stay here temporarily.|||sorry buddy, you can't apply for a greencard. you can try, but be prepared to waste the money and receive a denial letter.

Can an F1 visa marry a person who had just got his green card? where can we file a change of status?

im an international student and im about to marry my boyfriend who had just got his green card. we were just wondering where can we find an application form for that change of status? or can i really change my status as his dependent?|||Even if you marry your boyfriend who has a green card, your status will not change right away. If he sponsors you, it could take years before you are approved because he is not an American Citizen.|||Sure you can get married but the F1 can't have a change of status.

The F1 student visa is not an immigration visa so that is why it can't have a status change. The marriage will not change that.

The person signed an agreement to leave the country once the F1 is expired.

If they stay they are subject to deportation and a 10 year ban.

So here is what you do. The person goes home before you get married. Then you apply for a K1 fiance visa and then get married in the US.

You can then apply for the green card.

As I stated if you marry first, or overstay the F1 visa all bets are off.|||You can get married and he can file for you, however since he is a green card holder you will be waiting 2-3 years before you are able to become a green card holder also.

How will divorce effect green card/visa/residency status?

A women came to the US on a fiancee visa and married. Now she wants to divorce for legitimate personal reasons, not as a residency scheme. How will this effect residency status? Could she be deported?|||It depends largely on how long she has been married and if she still has a conditional residency green card. If she's been married for less than 2 years, it's going to be very difficult to preserve her current status in the US. If she loses her status and doesn't leave or find some new status, then yes, she would be subject to deportation, and at the very least, she'd be illegal. There are a few limited exceptions to the 2 year requirement. She should talk to an immigration attorney and see whether they might apply to her and to explore her options, if any.|||I would assume that yes she could be deported. She might be able to apply for citizenship.|||unless you can prove yourself a battered wife you will loose your status as we say in America you got to go its reasonable to believe that she will be investigated by ICE for marriage fraud|||If she has been married at least 2 years, she will be able to apply for the citizen test or continue with the green card. After the 2 year green card you will get a 10 year green card. When you get your 1st 10 year card, they remove the status from your card (getting a green card when married to an American). I know from personal experience, was married to an American for 5 years when I left him, they will not 'kick' you out, unless you committed a crime.

Does lying about your status on I-9 automatically disqualify you as a candidate for green card?

I lied about my legal status to work in the US. I am now married to a US citizen and had my immigration interview. The interviewer asked to give I-9 forms from my employer as further evidence and have 30 days to respond. I know that they will know I have lied on my I-9. Does that mean I will not get my green card even though I am married now to US citizen?|||you committed a HUGE "mistake" one that may well end up with you being in some serious trouble I do hope you have a great lawyer.|||The felony you committed guarantees your deportation and permanent bar to reentry. Consider yourself lucky if you do not spend a few years in prison prior to deportation. Get your butt out of the US yesterday. You are in that much trouble. You have NO chance of any visa, green card, or anything else in the US ever! Furthermore, you are flagged for immigration fraud and can plan on going nowhere but your country of citizenship for the rest of your life. Get out this instant. You cannot wait - unless you want to go to prison.|||If you indicated you are a US citizen on the I-9, that will make you ineligible for a green card. Falsely claiming US citizenship makes someone inadmissible. There is no waiver available for it, and the penalty is high. I don't agree with the harshness but it's the law right now.|||You committed fraud. You will never get a green card even if you are married to a citizen. You will be deported with a lifetime ban on returning.|||It's not automatic but highly likely that your application for a green card will be denied. Marrying a US citizen does not confer immunity from the legal consequences of falsely claiming US citizenship or LPR status.|||As long as you never claimed you was a US citizen .. you may get thru this

Can US citizen take away someone Green card status?

Hi...i wonder if a US citizen (man) can take away his wife Green card(10 years) after divorce by reporting to INS?

His wife never cheat and they just always fight by different perception or way of thinking!|||No!!

The permanent residency is just that PERMANENT.

After the first 2 years on conditional residency your status can not be taken away unless you give it up or leave the country for a long time without good reason.

Even if you divorce during the first 2 years you can usually retain you residency as long as there is no indication that the marriage was solely to get a greencard.|||No way! A Green Card means that you are a permanent resident.Don't let him try to scare you,you have a legal right to be in the US.|||No. The citizen didn't issue the card so they cannot take it away. Divorce is irrelevant.|||Why would you want to strip her of what you鈥檝e given her? You鈥檝e introduced her to a way of life - one most of us here consider being great (best ever) civilizations to grace the face of this planet.

If she hasn鈥檛 hurt you in another way than your pride, get over it.

Live %26amp; let live|||Not only can he not take it away, the odds are that the fighting can be redefined as a form of abuse and she can self-sponsor citizenship if she so chooses.

" if the wife has a green card, and it is not a "conditional" green card, separation or divorce will not have any affect on her immigration status. A wife will receive a " conditional green card" if the marriage occurred within two years of her entry into the United States as an immigrant or her adjustment of status in the United States to legal resident status. If she married more than two years before these events, then she will receive a green card that is not conditional.

If the wife received a conditional green card, then she and her husband must file a "joint petition" to remove the condition, two years after she received legal resident status. At that point, she becomes a full-fledged permanent resident. Where a wife has a conditional green card and must file a joint petition with her husband, she will not be able to file the joint petition if she divorces the husband. In order to file the joint petition, the couple must be married at the time the petition is filed. Even if the couple is married, an abusive husband will often threaten that he will not file the petition. This in itself may be a form of abuse.

However, the immigration law gives the wife protection by permitting her to file a waiver from the normal requirement of filing the joint petition. A conditional resident does not need her husband to file the petition. She can file an application to waive the requirement of filing the joint petition. Also, she does not have to wait two years to file the waiver, she can file it at any time.

If she divorces her husband, whether for abuse or any other reason, all that is required to remove the condition is for her to show that she entered the marriage in good faith and the marriage has been terminated by divorce or annulment.

Irrespective of whether the couple is divorced, she can file a battered spouse waiver. She must show both that she entered into the marriage in good faith and that she or her child was battered or subject to extreme mental cruelty by the U.S. citizen or legal resident husband.

Irrespective of whether the couple is divorced, and irrespective of whether or not there was abuse, she can file an extreme hardship waiver. To obtain this waiver, she must show that her deportation would result in extreme hardship.

The easiest waiver to obtain is one based on divorce. All the woman must show is that the marriage has been terminated and she entered the marriage in good faith. If the woman can show both that she entered the marriage in good faith and that she or child has been the victim of abuse, then she can obtain a battered spouse waiver whether or not the marriage has been terminated. The extreme hardship waiver is also available whether or not the couple is divorced, but, as a practical matter, this is very difficult to obtain. "|||except the US govt ( homeland security) no one has a right to take your greencard

International Travel

A Permanent Resident of the United States can travel freely outside of the US. A passport from the country of citizenship is normally all that is needed. To reenter the US a Permanent Resident normally needs to present the green card (Permanent Resident Card, Form I-551) for readmission. A reentry permit is needed for reentry for trips greater than one year but less than two years in duration.

You can find more information about travel documents from "How Do I Get a Travel Document?"

Maintaining Permanent Residence

Maintaining Permanent Residence You may lose your permanent residence status if you commit an act that makes you removable from the United States under the law in section 237 of the Immigration and Nationality Act. If you commit such an act, you may be brought before the immigration courts to determine your right to remain a Permanent Resident.

You may be found to have abandoned your permanent resident status if you:

Move to another country intending to live there permanently.

Remain outside of the US for more than one year without obtaining a reentry permit or returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.

Her child who was born in the U.S. can come back at anytime.

It's too late for her to apply for a re-entry permit so the SB-1 visa is her only hope if she is gone for more than a year.

According to section 101(a)(31) of the INA, the term "permanent" means a relationship of continuing or lasting nature, as distinguished from temporary, but a relationship may be permanent even though it is one that may be dissolved eventually at the instance either of the United States or of the individual, in accordance with law.

A permanent condition can come to an end.|||I thought with a green card that one could be out of the country for no more than six months at a time without the government considering the card to be abandoned. Can I legally work in the US with just using a Indian status card living in a border province like ontario?

You need a working visa to work in the US legally. To get this you need a US company to sponsor you. There is a quota set by the US immigration on how many working visas are allowed. This quota is very quickly filled.|||i think this question would be more applicable if you were talking about a border province like quebec, for the simple fact that it is not as much public property to the citizens of the united states as ontario is perceived

the quebecois are a little bit more nonchalant about it's amalgamation with the united states of america as ontario, for instance look at the geographic regions surrouding ontario, it is more like it should be called upstate new york, michigan, indiana, ohio province all together in one name

so the answer to your question is what is the difference in my point of view where you go in the periphery of great lakes ontario it is not going to be a truamatic difference in measures of governing or principality,

Every attorney knows that it is a crime for an American citizen to marry an illegal alien in order to obtain a green card or to help them stay in the United States. It is a felony punishable by imprisonment and the illegal alien will be detained by the INS and/or FBI and deported.

You will be denied the scholarship because you are an illegal alien and don't qualify. You should have told the truth from the beginning instead of sneaking around trying to take the scholarship that rightfully belongs to a deserving AMERICAN CITIZEN.|||Obama, Pelosi, Reid and almost all the Dems in Congress are committed to giving a mass amnesty to illegal aliens. It may not happen next year, but it will certainly occur by 2010. Only a GOP filibuster in the Senate can stop it from happening.

The Obama Biden Immigration Plan http://change.gov/agenda/immigration_age鈥?/a>

For too long, politicians in Washington have exploited the immigration issue to divide the nation rather than find real solutions. Our broken immigration system can only be fixed by putting politics aside and offering a complete solution that secures our border, enforces our laws, and reaffirms our heritage as a nation of immigrants.

Create Secure Borders: Protect the integrity of our borders. Support additional personnel, infrastructure and technology on the border and at our ports of entry.

Improve Our Immigration System: Fix the dysfunctional immigration bureaucracy and increase the number of legal immigrants to keep families together and meet the demand for jobs that employers cannot fill.

Remove Incentives to Enter Illegally: Remove incentives to enter the country illegally by cracking down on employers who hire undocumented immigrants.

MASS AMNESTY: Bring People Out of the Shadows: Support a system that allows undocumented immigrants who are in good standing to pay a fine, learn English, and go to the back of the line for the opportunity to become citizens.

Work with Mexico: Promote economic development in Mexico to decrease illegal immigration.

How long do I need to keep a credit card in active status in order to avoid damage to my credit score?

Be as detailed as possible please.|||Not entirely sure what you mean. It is true that under certain circumstances, you should not cancel an active credit card. For example, the credit companies consider a certain number of credit cards to be optimal (three or four I think); if you have more or fewer accounts, it affects your score slightly. If you want a perfect score you'll want to cancel or add accounts until you hit that ideal. But as far as I know canceling an account isn't disasterous to your score. There is one case you have to watch out for: Never cancel your oldest card. The length of your credit history is determined by the length of time of the oldest account. If you cancel that account, in six years it drops off, and then there is no more record of having credit during that time period! Your length of experience can go way down and this will definitely affect your score adversely.|||The statistics show that if you have a credit card, you are MUCH more likely to acquire bad credit than if you don't have one at all. You should rip that credit card up, or at least put it in a bowl of ice and stick it in the freezer. Any negative effect on your credit is sooooooooooooo minor that you will hardley be affected at all. Check out www.daveramsey.com for more great advice.|||How long must a card remain 'active' before my score is lowered?

Actually. your credit score rises the longer it is active. Of course your definition of active and the creditor's, credit bureau's and mine may vary.

I consider any open credit card as active. Delinquency above a few short time lates will quickly close it to further use.

To me, a card must be used at least once in two years, or the creditor is likely to classify it as 'inactive'. This DOES NOT hurt your credit score, however, this is done for security reasons. A quick call usually reinstates it right away.

"Active' and 'inactive' are relative terms, and neither adds or subtracts points.

Immigration- I have a green card. How long can I stay outside U.S before I lose my green card status?

A Permanent Resident of the United States can travel freely outside of the US. A passport from the country of citizenship is normally all that is needed. To reenter the US a Permanent Resident normally needs to present the green card (Permanent Resident Card, Form I-551) for readmission. A reentry permit is needed for reentry for trips greater than one year but less than two years in duration.

You may be found to have abandoned your permanent resident status if you:

- Move to another country intending to live there permanently.

- Remain outside of the US for more than one year without obtaining a reentry permit or returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.

- Remain outside of the US for more than two years after issuance of a reentry permit without obtaining a returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.

- Fail to file income tax returns while living outside of the US for any period.

- Declare yourself a “nonimmigrant” on your tax returns.

PS: Nothing is said about any of this on the 'Welcome To The United States of America' letter. I just checked mine (I got it last Summer) and confirmed that. Green card holder file for unemployment in Virginia. How do they verify immigration status?

What is the process for permanent green card holder to file for unemployment? Do they need to submit a copy of their green cards?

And how does Virginia Employment Commission confirm immigration status? Or just submitting SSN to cross-matched your identity with Social security administration? |||If your SSC is "Valid for work only with DHS authorization" then you must submit a copy of your Green Card. |||Unemployment insurance is under the state's Dept of Labor. They have access to state DMV records, employment records, the employer's unemployment insurance records, and probably other types of state records as well. They can also access the same database employers use to verify authorization to work and immigration status, or contact immigration authorities directly, and they can verify SSNs.

It's the government! They can verify everything! When you go, be sure you have your passport, green card, Social Security card, and drivers license with you. You will need all of them.

Why is an American Express card a status symbol?

Why not a VISA or a Mastercard?|||Exactly. The American Express Card has no credit limit but it requires that you make payment in full each month. Why not just use cash if you have it? Well it is designed more for people that buy extravagantly but have money in different accounts. You buy a $500 dinner on your AE card then transfer the money from your savings account to pay it off at the end of the month.|||because they are pickier about who they give credit too.

Alot of people don't have a CREDIT LIMIT.

and most accounts (except for some recent plans) require you to not carry a balance (you have to pay it off in full each month) so it is a RICH peoples card, Stars and etc.

Most of us carry a balance because we live out of our means.|||I used to think the same thing until I got one and I'm not rich by any means. I think they have some nice benefits but they also have an annual fee so I cancelled mine.

Green card holder marrying an out of status person that entered the us legally?

my friend is a green card holder and married his wife now who had overstayed her visa, they want to change her status and he wants to file for his citizenship. what is the best route to take in getting his wife legalized in the u.s and is there any consequence for my friend who married a out of status person?|||It would be best for him to apply for citizenship first and then file for her to adjust status once he naturalizes.

If he files for her as a green card holder, 1.) They would have to wait several months for the I-130 priority date to become current 2.) Once it is current she will still not be eligible to adjust status as overstaying is not forgiven in relatives of permanent residents.

Once he is a citizen, 1.) There is no wait time for a visa number so they could immediately file for adjustment of status without waiting several months 2.) Her overstay will be forgiven since she is an immediate relative of a US citizen, as stated in the Immigration and Nationality Act.|||You friend can not do anything to legalize her status because his wife is out of status. She is going to remain illegal. Only remedy at this point is for her to take volunteer departure to her country of origin, and her husband then apply for her immigrant visa. She will enter as a permanent resident.

Husband can not apply for her citizenship.

If she chooses not to take volunteer departure, and then gets caught and deported, there is a 5-10 year ban on re-entry. Also, having kids, married to green card holder, or US citizen can not stop deportation.

Best of luck.|||it really depends more on just how soon they really believe he'll get citizenship. she can't adjust status in the US if he's a greencard holder. But, she can apply to adjust status if he's a US citizen, since she arrived on a visa, assuming it wasn't a C1/D or a K-1 as those are exceptions. check out www.uscis.gov and read through the instruction sheet for the I-485 adjustment of status form. But, if you take a look at the Visa Bulletin http://travel.state.gov/visa/bulletin/bu鈥?/a> As of December the priority date for F2a petitions will be 1 August 2010. So, it may actually be faster for her to go home while he files a petition for her now. Of course, if she's been out of status for over 6 months, she'll be ineligible for three years and would need to apply for a waiver, which would slow her down. as for your friend, there's no legal consequence to him for marrying someone out of status. it just makes life more complicated while he's trying to find a way to get her legal status with him.|||They should marry first

Send the wife back home and then file a I-130 for her

Is it possible to remove someone from their green card status by calling immigration?

Probably not unless you can prove they have committed a crime and are willing to testify.|||yes, if you can prove wrong doing, their green card status can be removed as well as the person. Please report any wrong doing as it looks bad on our country and on immigrants who really follow the law.

Can a "Work Permit" or a "Visa" be changed to "Perminant Residence" or "Green Card" status in the USA?

I was wondering if a USA work permit or Visa can be changed to "Perminant Residence" or "Green Card" status. If so how long does it take? I am not bothered about not being able to vote!

I currently reside in the list of countries that is under the "Visa Waiver Program"

Thank you.|||If you get married to an American, and stay married to the citizen for about 4 years or so (it took quite a long time when we did it), then you can apply for permanent residence.

It is of no use to try to fleece an American into marriage if it's not for real, because the time required for the permanent residence paperwork (years...) is way too long for anyone to pretend to be married. Basically. :It's also illegal. :)

There are other ways to get what you want, but I think it is not as easy, or as sure.

I'm a Filipino citizen. How can I infinitely stay in the Philippines and maintain my US Green Card status?

I don't intend to abandon my US permanent residency. It's just that I have a business in the Philippines that requires my presence.|||you can't, the Permanent Resident Alien card means what it states that you will reside and work in the u.s. on a permanent basis and not that that you can come and stay at your convenience. you have a choice on were you want to live. so the ball is in your court now, either pass or play|||If immigrations believes that you intended to abandon your permanent residency, you may lose your green card. Your status may be lost if you are out of the country for more than six months; more than a year and it is lost. Returning now and then usually is not enough to keep your status.

If you believe you will be out of the country for more than a year, apply for a re-entry permit before you leave. You can download the required form, I-131, at www.uscis.gov. A re-entry permit does not necessarily guarantee that you will be admitted again with no problems, however.

It is also recommended that you continue filing taxes in the U.S.; maintain an address in the U.S.; keep and renew your drivers license, green card, etc.; keep your credit cards, any property... you get the picture.|||Dude, how many times are you going to ask this question? I've seen this same question on this forum all this week (and part of last week).

Ok, FOR THE LAST TIME! READ MY TYPING! The ONLY way you MIGHT be able to salvage your US Residency is if you apply for "advance parole" (Form 1-131). THis is a form that lets Immigration know that you, as a Green Card Holder, will be outside the USA for more than 1 year. HOWEVER you must apply for this BEFORE you leave the USA. Apparently you already LEFT the USA. You are already in the Phillipines. There is no way you can apply for Advance Parole if you're outside the USA.

Why can't you just become a Citizen? It'll make life so much easier. Green Card Holders should KNOW BETTER than to get jobs that require their extended absence from the USA.

Speak to an attorney, ok?|||GREEN Cards are only TEMPORARY.....sorry, you lose!

Is it possible to remove someone from their green card status by calling immigration?

For instance my nephew got a green card, and is 19 years of age, i filed the papers for him through adoption. But since he got the green card he is not using it for his good, instead of maybe applying for a job he just stays at home and is not using it to his advantage, he hasn't commited any crime though.|||No its not possible to remove someone from their green card status.

If you for any reason ask for the same you will be questioned first since you were the one who filed the papers through adoption.

Always think before you do some thing like this which involves legal issues.|||he is 19 years old, therefore, he isn't your responsibility. make him move out.|||No, there is nothing you can do but kick him out and let him learn that he needs to grow up and get a job.|||nop, unless he commits a felony.|||The INS is impotent. Make so by our do-nothing Congress and all of the politicians who choose to look the other way as our country is over run by people who come hear to make money and who could care less about our borders, culture and language.|||And....why would you even want to do such a thing?

Even if it were possible, like being a lazy couch potato would make you lose your green card, which would not, why would you even want to do such a thing? For your "adopted" nephew to just become an illegal lazy couch potato?

He's 19. He's an adult. Kick him out.

Okay, be nice...find him a job and give him the choice of taking the job of hitting the road.|||well as long as he is under your legal care? until he is a citizen? he is under your care,

What happens to your green card status if you have been in USA one year and the marriage is falling apart?

If you came to America on a Fiance' Visa, then marry, but then after a year divorce is a serious possibility? How does this affect one's immigrant status?|||That would depend on if you have filed for an American citizenship or not. If you have, then it is quite possible your visa status will not be affected. For better assurance consult an attorney whom specializes in immigration. Good luck to you.

What is the purpose of a canadian status card and what does it allow you to do?

a few friends from canada mentioned canadian status cards let you travel to the us without a passport...

is this true? and if not what is the purpose of the status cards?|||I am going to assume that by status card you are referring to the Certificate of Indian Status Card issued by Indian and Northern Affairs Canada. This card is issued to all people who meet the requirements of registering as a Status Indian under the Indian Act. Under specific treaties a person with this card can live and work in the US without going through regular immigration channels. This is due to the fact that the border in many cases cuts through the traditional First Nation lands so treaties were put into place to allow free access.

The current Status Card is being accepted without a passport under a grace period however there is no guarantee that it will last for any length of time. Many First Nations people already have either a passport or enhanced driver's license and use these. At present, the Canadian Government is developing a secure Status Card similar to an enhanced driver's license or passport card. Once in place a First Nations person will be able to apply for the new card which will be accepted in place of a passport. A number of test cards have already been issued however further work is being done on the cards before they are issued to the full native population. To apply for and receive one of these cards a person must prove their status the same way a person applying for a passport must provide proper identification.|||They are issued to Native Indians and with them There is No Border.|||A Canadian stutus card gets you a gift bag a the border which

includes:

- A beaver

- $20 in loonies

- A gift card to roots for $29.95

- A Molson Canadian (stubby)

- A guide book for Americans who under Canada health care system

all become hypochondriacs|||Its an Indian Status Card. Right now, it is the only piece of identification a Native needs to cross the border. I still need to go and pick up my enhanced Status card, which looks like a newer Canadian driver's licence. In order to qualify for a Status card, you must be a registered Indian, and fall within the boundaries of the Indian Act.

How old do you have to be to apply for a status card?

18 I'm assuming.

How to maintain status if your opt is expiring soon and application for green card pending?

hi, i am currently working for a company with a OPT which will expire in July of 08. The company has already started the green card process but they say that it might take a year or two before i actually get my hands on the green card. So how do i maintain my status until then? Can OPT be extended? What other choices do i have?

plz help. any suggestion would greatly be appreciated! thanks.|||The maximum period of OPT is 12 months and cannot be extended beyond that period. If you cannot find another nonimmigrant classification to change to, or if you cannot return to school full-time in order to maintain your F-1 status, then there will be no way to maintain a nonimmigrant status.

You will have 60 following the end of your OPT authorization to depart the U.S. After that time period, if you are not maintaining some nonimmigrant status, you will be unlawfully present. That might be a good time to return to your home country for a family visit.

Most employment based immigrant visas are current or do not have long waiting periods. You probably deserve a nice vacation after all that time in school and a year of work. If your immigrant visa is not ready, and you cannot adjust status, your best bet would be to avoid the accumulation of unlawful presence at any cost.|||OPT cannot be extended, but your US Employer can petition and file H1B visa for you which is Temporary Workers Visa. If approved you can get 3 year visa and can be extended another 3 years. In the mean time, if your employer files green card petition, which is muli step, complicated, time consuming process, you can get extension of H1B while your green card case is pending. Better have your employer to start H1B process very soon, since last year's H1B application was maxed out on the 2nd day of filing, which was April 2nd. And USCIS refused accepting any application after that day and went to random lottery method to process the applications. Good luck!

How can I keep my LPR status (Green Card) while working in Canada?

I just had my green card issued.. however, new things developed and I will have to work in Toronto Canada for the next 4-5 years.. in the meanwhile, how can I maintain my green card?|||Canada would NOT grant you permission to work in Canada, unless you drop your US resident status , first. You can't be BOTH at the same time, it is not allowed.

Jim B. Toronto.|||Number one, you would have to file an income tax return in the U.S. as a resident on your world wide income. Your income in Canada would have to be reported on form 1040, and you would have to file as a resident.

If you don't want to pay income tax on your world wide income, and very few people could blame you if you didn't want to, it would be impossible to keep your card.

In general, the factors that are considered in determining abandonment of resident status are the duration of the alien's absence, the location of the alien's family ties, property holdings, job, and the intention of the alien with respect to both the location of his actual home and the anticipated length of the absence.

An absence of 4 to 5 years rarely would be considered brief or temporary. At the end of the 4 - 5 years, you would have the burden of proving that you are returning to an unrelinquished domicile after a temporary trip abroad.

You'd be better off going for another immigrant visa at the end of your time in Canada. Perhaps you can use the same petitioner.|||you cant - you cannot be outside of USA for more than 2 years in any 5 year period, (and you must ask permission first) otherwise you WILL LOSE the green card status

saying that you want to work out of USA is NOT a good reason to leave USA for 2 years - you should be working inside the USA|||Jim ...that's nonsense

Does Paypal charge your card when it is in Pending Status?

Can you renew a green card after getting a deserter status in the military?

He was a drill instruction in the marine corps during his re-enlistment. He was discharged with 'other than honorable' for being too 'rough' on the recruits. He went UA(deserter status) for not going back to base after his separation. He was arrested for a traffic bench warrant, transfered back to base, served a month in military jail and then placed back on active duty until his separation time expired. will all this effect his ability to renew his green card?|||speak to an Aila lawyer before he files ...|||it's possible, that's one of those gray areas that would require a lawyer. Doesn't sound like a very responsible person to me|||Here is what I don’t understand. First everything you said except Military Jail are terms the Marine Corps use. However, what I don’t understand is he has a “Discharge Other Then Honorable” so he got his discharge why would he be expected to stay on base after his discharge? My only guess is he really messed with someone to where they “lost” his discharge forms and then he has a UA.

Also when you’re giving a Discharge often for example those in Boot Camp who don’t cut it they will be forced to wait for weeks/months/years in boot camp in Routing then Recruit Separation Platoon and even when you get your discharge papers you cannot leave until your bookings are all set and done and your ride gets there to take you to the airport or the greyhound terminal.

I am guessing he had to go into a similar situation to where he had to wait to be discharged. If he is still in, he should be able to stay but if not a Discharge Other is pretty much a Ghost Discharge. You’re records and you are null after six months unless it’s a dishonorable discharge. So for all his time in, it didn’t leave a good nor bad impact on his record, other then him getting arrested obviously.

But yeah once you get a UA once someone looks at your records or pulls you over, you go right back to base, go to the brig and then go back into the very long process of separation.

He did wrong though, now he knows what those poor recruits who stepped on those Yellow Foot Prints had to go through. Typically, people who complain about Drill Instructors well their paper work is lost and this caused them to sent to routing and back sometimes as punishment and then back into boot camp. One guy was in Recruit Separation Platoon for over two years.

If i had voluntarily given up my green card and wish to reinstate my status would that be possible?

I would like to know if there is a procedure for persons who wish to return to the USA but previously had a green card and given it up. What if there was a good reason for this to be done at the time and being that the situation had changed can he/she reapply for his/her status?|||you can try to get a greencard the same way you got it in the first place. If that is still an option. You cannot "resurrect" a greencard you've given up.|||You can reapply, but you will need to go through the whole process all over again.|||If you return you green card with Forn I-407 ...

you would have to go through the whole procedure again to get it again

It cannot be re-applied for one gone|||if you can show proof of reason for giving it up and can meet all requirements for a green card yes you can. but you will be put at the end of the list and need to wait your turn.

The atm says my card has a bad status. What could this mean?

I tried to pull money out of my atm and I got an error code 8324 and it said my card has a bad status. Has this happened to anyone before?|||Turn the card over and call the 1-800 on the back and ask customer service.

They will be able to tell you what is going on with your card and your account.|||Yes all the time. I create a lot of body static and am always shorting out the cards be it atm, credit and even hotel room keys. If your card came in contact with a magnet, cell phone it stops working.
