I was on Student Visa before I got my Green Card.|||Instead of filing a joint application (you and your spouse) to remove the conditional status of your card, you will have to file the petition to remove the conditional status of your card alone. You will have to request a waiver of the requirement of filing a joint I-751 petition.
Take a look at form I-751 and its instructions. The conditional status is an anti-fraud measure and is necessary to provide updated proof of a bona fide marriage in support of the I-751 form.|||So I'm guessing by what you said, that you've had a green card BEFORE you got married? If you've only been married a year %26amp; have had the card for 2 years, than I'm assuming that's the case. If it is, I don't think that it will necessarily affect you being here, of course, that's my personal opinion. Again, from what you said, it sounds like you applied a year before getting married... which is alot better than what MOST people do who come here illegally...|||If you have not applied for your unconditional green card when you separate/divorce, then you will have somewhat of an uphill struggle on your hands. You will have to be able to show and prove that the marriage was entered into with good faith. That it was real. Even then they may still deny you.
